Covered parts and equipment shall include only the motor-compressor assembly (the “Assembly”) consisting of the rotor, eccentric rod, piston, wrist pin, suction valve, discharge valve and the housing in which these parts are enclosed. The warranty does not apply to any other parts or equipment, and, without limitation, specifically excludes any equipment to which the Assembly is connected (such as cooling coils, temperaturecontrols, refrigerant, metering devices, etc.), and any other parts, such as the condenser, receiver, connecting tubing, and electric controls such asrelays, capacitors, pressure control or fan and motor assemblies.
If, during the term of this Warranty, any Assembly is found to be defective in material or factory workmanship under normal use and regular service, Heatcraft will reimburse to the original Purchaser-user, named above, the cost of a replacement Assembly or replacement parts, as applicable, less the fair exchange value of the part found to be defective. A determination of defectiveness shall be made by the nearest compressor wholesaler to which the part shall be delivered for inspection by the Purchaser-user. The amount of such reimbursement shall not include any charges for freight or for labor of any kind (including, but not limited to, the labor associated with the disassembly, reassembly, repair or other work performed on the equipment), nor for any other expense in connection with such exchange, repair or replacement. Purchaser-user shall establish the amount of reimbursement due by submitting to Heatcraft a true and correct copy of the wholesaler’s net invoice and credits for the replacement Assembly or parts. Notwithstanding anything to the contrary herein, in no event shall Purchaser-user be entitled to total reimbursement hereunder exceeding the “limit of Liability” amount reflected below.
